These Terms of Service ("Terms") govern your use of our daycare services, website, and any related services provided by Shelly Vaughn at 2025 Ernest Way, Arcata, CA 95521. If you do not agree to these terms, please do not use our services.

A Garden to Grow Daycare provides licensed home daycare services for children in a safe, nurturing environment. Our services include:

• Child care and supervision during operating hours
• Age-appropriate educational activities and play-based learning
• Meals and snacks (as specified in enrollment agreements)
• Communication with parents and guardians about child development
• Safe and secure environment for children to grow and explore

As a parent or guardian using our services, you agree to:

• Provide accurate and complete information about your child and family
• Notify us immediately of any changes in contact information or emergency contacts
• Ensure your child arrives and departs at scheduled times
• Follow our policies regarding illness, medication, and emergency procedures
• Pay fees in a timely manner as agreed upon
• Respect our staff, other children, and facility rules
• Provide necessary supplies and items for your child's care
• Keep us informed of any special needs, allergies, or medical conditions

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of A Garden to Grow Daycare or its content suppliers and is protected by copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written consent.

Photographs and videos of children taken during daycare activities may be used for educational purposes, documentation, or promotional materials with parental consent as outlined in our enrollment agreements.

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding:

• The uninterrupted availability of our services
• The accuracy or completeness of information provided
• The suitability of our services for any particular purpose
• The compatibility of our services with third-party systems

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

To the maximum extent permitted by law, A Garden to Grow Daycare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Emotional distress

Our total liability for any claims arising from the use of our services shall not exceed the amount paid by you for our services in the twelve months preceding the claim.

Either party may terminate this agreement with written notice as follows:

• By Parent/Guardian: 30 days written notice is required
• By Daycare: Immediate termination may occur for serious violations of policies or non-payment
• Mutual Agreement: Both parties may agree to terminate at any time

Upon termination, all outstanding fees must be paid, and any personal belongings must be collected within 7 days.

Our website may contain links to external websites or resources. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of such external websites or resources.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

• Posting the updated Terms on our website
• Sending email notifications to registered users
• Providing written notice at our facility

Your continued use of our services after any changes indicates your acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of our services.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the use of our services shall be resolved in the courts of Humboldt County, California, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
